Court annuls election of roster headed by Jorge Rodas to direct the Guatemalan Olympic Committee

The Fifteenth Civil Court of First Instance, constituted as the Constitutional Court of Amparo, ordered the Electoral Tribunal of Federated Sports (Tedefe) to make a new call to elect the executive committee of the Guatemalan Olympic Committee (COG).

The decision of this Court was taken because the roster headed by ex-footballer Jorge Rodas was endorsed despite “not complying with the requirements established in the call for the registration of rosters, in addition to having inconsistencies not corrected within the registration application file and having presented an affidavit that contains false facts that vitiate the entire procedure ”.

The Constitutional Court processed the amparo filed by Claudia Lorena Rivera Lucas. The action was brought against the members of Tedefe, Elmen Vosbelí Mérida Méndez, César Florencio Gonón Portillo, Miriam Alicia Guerrero Rodríguez and Ricardo Aníbal Masaya Gamboa.

On October 7, two thousand twenty-one, Tedefe approved the registration of Jorge Rodas, María José Iglesias, Selvyn Ponciano, Walter Vásquez Monterrosa and Edwin Giovanni Gutiérrez Godínez as candidates for the positions of president, vice president, first, second and third member, respectively. , “Despite not complying with the requirements established in the call for the registration of forms, in addition to having inconsistencies not corrected within the registration application file and having submitted a sworn statement containing false facts that vitiate the entire procedure.”

The resolution establishes that they could “have incurred in perjury, among other crimes, for electoral purposes by Edwin Giovanni Gutiérrez Godínez, according to a complaint filed by the Court of Honor of the Guatemalan Olympic Committee.”

The Constitutional Court argued in its resolution that Gutiérrez Godínez “did not present the solvency issued by the Court of Honor of the Guatemalan Olympic Committee, a requirement indicated in literal” g “of the convocation, in its
defect accompanied an affidavit dated September 20, 2021 ”.

This situation, they considered, vitiated the registration process for form one. This, continues in legal analysis, demonstrated “a preferential and unequal treatment by the Electoral Court of Federated Sports.

For these reasons, it finally granted the provisional protection that they had been granted on October 21, 2021, which renders the election void and ordering “to make a new call to elect the president, vice president and members of the Executive Committee of the Guatemalan Olympic Committee.”

Tedefe now has a period of fifteen days, as of the notification of the resolution, “for it to comply exactly with what is ordered in this ruling, under warning that in case of non-compliance, a fine of four thousand quetzals will be imposed on each one of its members, without prejudice to the consequent civil and criminal responsibilities ”.

For now, Tedefe has not spoken and it is known that they are on vacation. It will be until January 2022 when they meet again, although by this resolution they could do so earlier.
